Privacy Policy

Your privacy is important to us. It is Big's Mobile Detailing's policy to respect your privacy regarding any information we collect across our website and mobile apps.

 

1. Information we collect

When you visit our website and mobile apps, our servers may automatically log the standard data provided by your web browser. It may include your computer’s Internet Protocol (IP) address, your browser type and version, the pages you visit, the time and date of your visit, the time spent on each page, and other details.

We may also collect data about the device you’re using to access our website. This data may include the device type, operating system, unique device identifiers, device settings, and geo-location data. What we collect can depend on the individual settings of your device and software. We recommend checking the policies of your device manufacturer or software provider to learn what information they make available to us.

Our apps & websites collect data that is processed ephemerally (it is stored in the memory for no longer than necessary to service requests in real-time for the sole purpose of app functionality. 

2. Personal information

Users can choose if they want the following data collected or not:

  1. User payment info
  2. Approximate location
  3. Precise location
  4. Photos & videos
  5. Files & docs

 

To use certain functions of the app and websites the following data is required:

  1. Name
  2. Email
  3. Street address
  4. Phone number

3. Legal bases for processing

We will process your personal information lawfully, fairly and in a transparent manner. We collect and process information about you only where we have legal bases for doing so.

These legal bases depend on the services you use and how you use them, meaning we collect and use your information only where:

  1. it’s necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract (for example, when we provide a service you request from us);
  2. it satisfies a legitimate interest (which is not overridden by your data protection interests), such as for research and development, to market and promote our services, and to protect our legal rights and interests;
  3. you give us consent to do so for a specific purpose (for example, you might consent to us sending you our newsletter); or we need to process your data to comply with a legal obligation.

Where you consent to our use of information about you for a specific purpose, you have the right to change your mind at any time (but this will not affect any processing that has already taken place).

We don’t keep personal information for longer than is necessary. While we retain this information, we will protect it within commercially acceptable means to prevent loss and theft, as well as unauthorized access, disclosure, copying, use or modification. That said, we advise that no method of electronic transmission or storage is 100% secure and cannot guarantee absolute data security. If necessary, we may retain your personal information for our compliance with a legal obligation or in order to protect your vital interests or the vital interests of another natural person.

4. Collection and use of information

We may collect, hold, use and disclose information for the following purposes and personal information will not be further processed in a manner that is incompatible with these purposes:

  1. to enable you to customize or personalize your experience of our website or mobile apps;
  2. to enable you to access and use our website, associated apps and associated social media platforms;
  3. to contact and communicate with you;
  4. for internal record keeping and administrative purposes;
  5. for analytics, market research and business development, including to operate and improve our website, associated apps and associated social media platforms;
  6. to run competitions and/or offer additional benefits to you;
  7. for advertising and marketing, including to send you promotional information about our products and services and information about third parties that we consider may be of interest to you;
  8. to comply with our legal obligations and resolve any disputes that we may have.

5. Disclosure of personal information to third parties

  1. We may disclose personal information to:
    1. third party service providers for the purpose of enabling them to provide their services, including (without limitation) IT service providers, data storage, hosting and server providers, ad networks, analytics, error loggers, debt collectors, maintenance or problem-solving providers, marketing or advertising providers, professional advisors and payment systems operators;
    2. our employees, contractors and/or related entities;
    3. sponsors or promoters of any competition we run;
    4. credit reporting agencies, courts, tribunals and regulatory authorities, in the event you fail to pay for goods or services we have provided to you;
    5. courts, tribunals, regulatory authorities and law enforcement officers, as required by law, in connection with any actual or prospective legal proceedings, or in order to establish, exercise or defend our legal rights;
    6. third parties, including agents or sub-contractors, who assist us in providing information, products, services or direct marketing to you; and third parties to collect and process data.
  2. For a better experience and in order to provide our service, we may required you to provide to us either directly, or indirectly, with certain personally identifiable information, including but not limited to your username and Auth credentials. This is for the purpose of syncing your Google Calendar with Big's Mobile Detailing, and Big's Mobile Detailing into your google calendar. This is achieved via: console.developers.google.com
    1. The username & Oauth2 credentials that we request will not be collected by us and will be used as described in this privacy policy. Your credentials will be collected by Google and their privacy policy for this sign-in can be found here: Google Sign-In for Calendar syncing

6. International transfers of personal information

The personal information we collect is stored and processed in the United States, or where we or our partners, affiliates and third-party providers maintain facilities. By providing us with your personal information, you consent to the disclosure to these overseas third parties. These third parties may include Amazon Web Services for cloud infrastructure and data hosting, Google for GPS mapping and routing, Pin Payments for AU credit card processing, Sendgrid for transactional emails, and Twilio for SMS messaging. We will ensure that any transfer of personal information from countries in the European Economic Area (EEA) to countries outside the EEA will be protected by appropriate safeguards, for example by using standard data protection clauses approved by the European Commission, or the use of binding corporate rules or other legally accepted means. Where we transfer personal information from a non-EEA country to another country, you acknowledge that third parties in other jurisdictions may not be subject to similar data protection laws to the ones in our jurisdiction. There are risks if any such third party engages in any act or practice that would contravene the data privacy laws in our jurisdiction and this might mean that you will not be able to seek redress under our jurisdiction’s privacy laws.

7. Your rights and controlling your personal information

  1. Choice and consent: By providing personal information to us, you consent to us collecting, holding, using and disclosing your personal information in accordance with this privacy policy. If you are under 16 years of age, you must have, and warrant to the extent permitted by law to us, that you have your parent or legal guardian’s permission to access and use the website and they (your parents or guardian) have consented to you providing us with your personal information. You do not have to provide personal information to us, however, if you do not, it may affect your use of this website or the products and/or services offered on or through it.
  2. Information from third parties: If we receive personal information about you from a third party, we will protect it as set out in this privacy policy. If you are a third party providing personal information about somebody else, you represent and warrant that you have such person’s consent to provide the personal information to us.
  3. Restrict: You may choose to restrict the collection or use of your personal information. If you have previously agreed to us using your personal information for direct marketing purposes, you may change your mind at any time by contacting us using the details below. If you ask us to restrict or limit how we process your personal information, we will let you know how the restriction affects your use of our website or products and services.
  4. Access and data portability: You may request details of the personal information that we hold about you. You may request a copy of the personal information we hold about you. Where possible, we will provide this information in CSV format or other easily readable machine format. You may request that we erase the personal information we hold about you at any time. You may also request that we transfer this personal information to another third party.
  5. Correction: If you believe that any information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, please contact us using the details below. We will take reasonable steps to correct any information found to be inaccurate, incomplete, misleading or out of date.
  6. Notification of data breaches: We will comply laws applicable to us in respect of any data breach.
  7. Complaints: If you believe that we have breached a relevant data protection law and wish to make a complaint, please contact us using the details below and provide us with full details of the alleged breach. We will promptly investigate your complaint and respond to you, in writing, setting out the outcome of our investigation and the steps we will take to deal with your complaint. You also have the right to contact a regulatory body or data protection authority in relation to your complaint.
  8. Unsubscribe: To unsubscribe from our e-mail database or opt-out of communications (including marketing communications), please contact us using the details below or opt-out using the opt-out facilities provided in the communication.

8. Cookies

We use “cookies” to collect information about you and your activity across our site. A cookie is a small piece of data that our website stores on your computer, and accesses each time you visit, so we can understand how you use our site. This helps us serve you content based on preferences you have specified.

9. Business Transfers

If Big's Mobile Detailing, or Big's Mobile Detailing’s assets are acquired, or in the unlikely event that we go out of business or enter bankruptcy, we would include data among the assets transferred to any parties who acquire us. You acknowledge that such transfers may occur, and that any parties who acquire us may continue to use your personal information according to this policy.

10. Limits of our policy

Our website may link to external sites that are not operated by us. Please be aware that we have no control over the content and policies of those sites, and cannot accept responsibility or liability for their respective privacy practices.

11. Changes to this policy

At our discretion, we may change our privacy policy to reflect current acceptable practices. We will take reasonable steps to let users know about changes via our website. Your continued use of this site after any changes to this policy will be regarded as acceptance of our practices around privacy and personal information.

If we make a significant change to this privacy policy, for example changing a lawful basis on which we process your personal information, we will ask you to re-consent to the amended privacy policy.

Terms & Conditions

This Agreement explains our obligations to you (hereafter referred to as, “Client”, “Customer”, or “you”) and Big's Mobile Detailing (hereafter referred to as “Big's Mobile Detailing”, “contractor”, “technician”,  “us”, “our”, or “we” ) and your obligations to us in relation to the service(s) you purchase. By using our service, you agree to the full terms of this agreement without modification by you. By using the services of Big's Mobile Detailing, you hereby agree to the following terms:

Booking Terms & Conditions

  • Customers should remove all personal belongings, money, and other significant items from their vehicle prior to any type of detailing.
  • We cannot guarantee any firm times when accepting your booking.
  • Our detailing times are an estimate only. Each vehicle is different and may require more or less time to fulfill the detailing type.
  • We reserve the right to use any independent contractor to undertake your auto detailing and may need to change the detailer at short notice without penalty.
  • Whilst every effort will be made to keep scheduled bookings to the requested arrival window, unforeseen circumstances may cause lateness and are done so without voiding our cancellation policy.
  • We reserve the right to take debit or credit card details to secure the booking. Debit/Credit cards shall be processed by Fieldd.co.
  • We reserve the right to alter or move a booking in line with staffing levels and/or weather conditions and/or machinery or equipment failure.
  • Big's Mobile Detailing will not accept any liability for any loss or damage to any personal property, including the vehicle being serviced, any belongings contained inside of the vehicle, or to the location of service. Assure that your vehicle is being serviced in a lawful and safe area and if you feel otherwise, please communicate your concerns with the technician.
  • Big's Mobile Detailing or its staff do not accept liability for discharged batteries during or after the service has been completed. Please inspect your vehicle after the service is rendered to ensure all interior lights, headlights, or running lights have been turned off.
  • All orders placed require address, package, and vehicle condition verification. Service requests are not guaranteed at the time of booking and may be canceled at any time at the sole discretion of Big's Mobile Detailing.
  • Big's Mobile Detailing reserves the right to refuse service to anyone.
  • Big’s Mobile Detailing reserves the right to refuse or deny customer demands above and beyond the booked detailing.
  • Big’s Mobile Detailing will not tolerate any verbal or physical abuse towards any of its staff under any circumstances and will take the relevant actions should any such behaviors be encountered.

Communications

  • Big’s Mobile Detailing will send you email and SMS text messages to confirm your service request, provide information about the detailer matched to your job, and conduct a customer satisfaction survey after the job is completed.
  • When your service request is received, your name, phone number, service address, and vehicle information will be saved to our database.
  • Big’s Mobile Detailing may call you directly regarding your scheduled service or conduct a customer satisfaction survey. In the event of a canceled request, we may call you to inquire about your reasons for canceling.
  • All inbound and outbound customer service calls may be recorded for quality assurance.

Our Service Terms & Conditions

  • We may ask you where you heard about Big’s Mobile Detailing in order to gauge our marketing strategies.
  • We must have permission to hold a debit or credit card to secure a regular booking, and we will charge the card after each visit.
  • We reserve the right to charge a debit or credit card the full amount should the vehicles(s) not be available for cleaning, and the booking has not been canceled in advance (see cancellation policy)

Cancellation Policy

  • We require 72 hours notice to cancel any booking/detailing service.
  • Failure to provide 72 hours advance notice of cancellation will result in loss of your deposit fee.
  • Same-day appointments that are canceled will also result in a loss of your deposit fee.
  • The 15% deposit fee is non-refundable if the appointment is canceled within 72hrs of the start time.
  • Big’s Mobile Detailing reserves the right to take full payment if a booking is canceled on the day without prior agreement.
  • Big’s Mobile Detailing reserves the right to alter or amend a booking time/date without penalty but, wherever possible, will let the customer know.
  • Big’s Mobile Detailing reserves the right to alter a booking or move a booking in accordance to its staff levels, weather conditions, and/or equipment failure without penalty to the company.
  • Failure to be present at the time and location of the ordered service will result in a loss of your deposit fee.

Service Guarantee

  • If there is a probable and clear cause that the service technician did not fulfill the package as ordered or there is clear evidence of poor craftsmanship, we will, at our cost, refund or redo the uncompleted or unsatisfactory portion of the service.
  • Cleaning or repairing the vehicle personally or professionally after the initial service without authorization from Big’s Mobile Detailing voids our Service Guarantee. Redos, refunds, or reimbursements will not be made after any unauthorized cleaning or repairs.
  • Refusing a redo appointment for the unsatisfactory portion of your service limits any refunds to 20% of the value of your service.
  • Failure to disclose at the time of booking any conditional issues that involve heavy stains, foul odors, human or animal biological waste, mold, mildew, chemical spills, chemical overspray, or any other hazardous materials voids our service guarantee. No refunds, redos or any additional work will be performed outside of the original package or estimate.
  • Some issues may require services beyond those you initially requested. Refusing the services recommended by customer service or your on-site technician may invalidate the service guarantee.
  • Only services included in your order and additional services authorized by Big’s Mobile Detailing are covered under our service guarantee. Any services not authorized by Big’s Mobile Detailing are at the customer's own risk.
  • Payment is due at the completion of your service. Refusal or failure to pay for your service invalidates our service guarantee, and any redo services or discounts are at the sole discretion of Bigsmobiledetailing.com.
  • Any claims must be filed within 48 hours of the completion of the service by emailing (info@bigsqazipupload.mystagingwebsite.com). Pictures of the unsatisfactory portion of the service must be emailed to info@bigsqazipupload.mystagingwebsite.com within 24 hours of the claim being made.

Providing Feedback and Photos

  • We ask for your feedback. Please send us an email at (info@bigsqazipupload.mystagingwebsite.com) and let us know if there are ANY concerns – good or bad.
  • We also carry the right at the discretion of Big's Mobile Detailing to use pictures of your vehicle for marketing purposes and to publish them on our website (www.bigsmobile.com) or any of our Social Media.
  • Your personal information will not be shown in the photos.

Gift Certificates

  • For payer verification purposes, Gift Certificates have a 48-hour holding period before they can be redeemed for services.
  • Gift Certificates can only be used once per vehicle per service.
  • Gift certificates can not be combined or redeemed with any other additional discounts, coupons, or promotions.
  • The final price for services rendered may exceed the value of this gift certificate.
  • Additional charges may apply to the redeemer if they choose a package that exceeds the cash value of their gift certificate.
  • Additional surcharges for excessive pet hair, biological waste, other hazardous materials, larger vehicles, excessive damage, or other issues may apply.
  • Gift certificates reflect a cash value. Prices for services may adjust due to seasonality, location, inflation, or demand.
  • Any balances for services ordered are due at the time of service and do not include additional services, tax, or gratuity.
  • In the event the redeemer is not covered by the Big’s Mobile Detailing network, a refund will be issued to the original payment method used at the time of purchase.
  • After 6 months of non-use, the gift certificate is non-refundable.

Changes

  • Big's Mobile Detailing reserves the right to modify this statement at any time.
  • Any changes to this Service Contract will be listed in this section,
  • Big's Mobile Detailing does not make any commitment to update the materials.
  • By using our services, you hereby understand that Big's Mobile Detailing does not guarantee any specific outcomes or results with our detailing services.
  • Big's Mobile Detailing limits its liability to the total dollar amount of each job.

Agreement

I HAVE FULLY READ THIS DOCUMENT “BIG'S MOBILE DETAILING’s Terms and Conditions of Service” AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I FURTHER UNDERSTAND THAT BY BOOKING ONLINE/OFFLINE, MAKING AN APPOINTMENT BY PHONE, OR IN PERSON, I VOLUNTARILY SURRENDER AND DISCHARGE “BIG'S MOBILE DETAILING” AND ALL OF ITS AFFILIATES, MEMBERS, STAFF, AND REPRESENTATIVES FROM ALL CLAIMS OR CAUSES OF ACTION AND AGREE TO VOLUNTARILY GIVE UP OR WAIVE ANY RIGHT THAT I OTHERWISE HAVE TO BRING A LEGAL ACTION AGAINST “BIG'S MOBILE DETAILING” FOR PERSONAL INJURY OR PROPERTY DAMAGE.
